Conservative Republicans in the US applauded President Bush’s reelection since he will now most likely have the opportunity to reconstitute the Supreme Court with judges who are committed to overturning the 1973 Roe vs.Wade decision that protects a woman’s right to choose abortion. To learn about where American society is headed under a second Bush administration, it is always instructive to read the 2004 Platform of the Republican Party. This document is a useful blueprint : everything is in there from legalizing discrimination against gays and lesbians, to dismantling the barriers between church and state – something that is foundation of the US constitution. With respect to a woman’s right to control her own uterus, it is clear that the goal of the Republicans – at least those who drafted the party platform – is to criminalize abortion. The pertinent section can be found on p. 84 of the pdf file referenced above. Here is a brief excerpt:
"We support a human life amendment to the Constitution and we endorse legislation to make it clear that the Fourteenth Amendment’s protections apply to unborn children. Our purporse is to have legislative and judicial protection of that right against those who perform abortions."
To this end, the voters of Oklahoma have elected Tom Coburn to the US Senate. Dr. Coburn has advocated the death penalty for physicians who perform abortions.
German women’s right to an abortion is guaranteed since 1995 under paragraph 218a of the Strafgesetzbuch. The provision clearly permits temination of pregnancy within the first 12 weeks as long as: a) she obtains counseling three days before the procedure; and b) the procedure is performed by a licensed physician.
After the 12-week period, however, the law becomes somewhat hazy. In general, late-term abortions are permitted in Germany when the health of the mother is at risk. Recently, the CDU has been trying to put further restrictions on late-term abortions, along the same lines as the recently passed legislation in the US against "partial birth abortions."
Die Union will daher auch für die medizinische Indikation eine
psychosoziale Pflichtberatung einführen. Die Diagnose soll von einem
interdisziplinär besetzten Ärztekollegium begutachtet werden; Ziel sei
es, den Eltern „umfassende Hilfestellung bei ihrer Entscheidung zu
geben“. Zudem verlangt die Union eine Ergänzung des Paragraphen 218:
Eine Behinderung des Fötus sei allein keine Gefahr für das Leben und
die Gesundheit der Mutter – da ja eine Behinderung kein Grund für eine
Abtreibung sein dürfe.Für notwendig hält die Union zudem eine
Bedenkzeit von drei Tagen vor einem Schwangerschaftsabbruch. SPD und
Grüne lehnen vor allem Pflichtberatung und Ärztegremium ab, da Frauen
in diesem schweren Konflikt noch zusätzlich unter Druck gesetzt würden.Die Union fordert außerdem eine Änderung des
Arzthaftungsrechts. Nach Entscheidungen des Bundesgerichtshofs müssen
Ärzte nach mangelhafter Pränataldiagnose Schadenersatz und lebenslangen
Unterhalt für das Kind zahlen. Manche Ärzte verhalten sich deshalb
defensiv, sie empfehlen im Zweifelsfall eine Abtreibung. Die Union
schlägt daher vor, zu prüfen, ob sich die Arzthaftung auf „grobe
Fahrlässigkeit“ beschränken lässt.Das
Bundesverfassungsgericht, heißt es im Unions-Antrag, habe bei der
Abtreibungsreform verlangt, dass nachgebessert werden müsse, wenn das
Gesetz dem Lebensschutz nicht genüge. Bei der Spätabtreibung sei dies
notwendig. Mag sein, dass die Union in diesem Punkt keine juristische
Unterstützung findet: 2002 bezeichnete der Bundesgerichtshof
Spätabtreibungen als rechtmäßig, wenn die Gesundheit der Mutter bedroht
ist.
Many abortion rights advocates see these type of restrictions as first steps in eliminating hard-fought rights. No doubt this kind of pressure will only increase if the next Pope is a German.
