Freedom of Expression? The Case of the Berlin School Teacher der Volkslehrer

Interesting case reported by the Berlin daily newspaper Der Tagesspiegel.  The paper discovered that a teacher at one of the Berlin elementary school has a separate life as an YouTube conspiracy theorist:

Nikolai N., 37 Jahre alt, unterrichtet seit zwei Jahren an der Vineta-Grundschule in Gesundbrunnen. Davor war er bereits an zwei anderen Berliner Schulen. Mehrfach gab es Beschwerden. Er wurde anonym bei der Schulaufsicht gemeldet, zum Gespräch geladen. Doch man ließ ihn weiter unterrichten.'

Some of the "theories" Nikolai N. espouses on the Internet:

  • The history of the Holocaust is a lie.
  • German Basic Law (Grundgesetz) is not constitutional
  • The moon landing never happened
  • Osama bin Laden had nothing to do with 9?11
  • The Sandy Point killing of 20 pupils in Connecticut was "staged"
  • Germany is "occupied" by the US and hence not a sovereign nation.

Actually, Nikolai goes beyond simply stating his opinions:  he also actively disrupts events – such as a forum with Angela Merkel – where he doesn't agree with views.  He is more of a provocateur.

But the question is: are Nikolai N.'s crazy views protected Free Speech according to German law?

Es gilt die freie Meinungsäußerung, solange diese nicht gegen geltendes Recht verstoßen. Und Beschwerden seitens der Vineta-Grundschule, an der Nikolai N. Unterrichtet, hat es wohl nicht gegeben. Auch deshalb sei es schwierig, ihm vom Schuldienst zu entfernen, erklärt Tom Erdmann, Landesvorsitzender der Lehrergewerkschaft GEW.

If he carried out his duties as a teacher – adhering to the lesson plan – and didn't try to indoctrinate his classes with his "theories", then his outside activities should be irrelevant to his teaching job.  But that isn't the case.  Evidently the Volkslehrer was actively promoting his ideas to the impressionable young minds in the classroom.

"Es hat eine Weile gedauert, bis wir realisiert haben, was da in der Klasse läuft. Mein Kind erzählte mir irgendwann sehr überzeugt, dass es Ebola gar nicht gibt und die Pharmaindustrie die Krankheit nur erfunden habe. Außerdem hätten die Ägypter die Pyramiden gar nicht gebaut, sondern wahrscheinlich Außerirdische…", berichtet ein betroffenes Elternteil.

Apparently, rather than teaching English and the other subjects, the teacher would spend the hour talking about the "Illuminati" who rule the world

School officials knew all about the Volkslehrer and his activities both in the school and outside, but continued to allow him to teach.  Only after the Tagesspiegel reported on this was he finally relieved of his teaching duties.

I liked your expression. It seems that as a teacher, you want to share everything with the students. As a teacher, you are doing a good job. You will spend extra time to teach English and other subjects for students. Students should take benefits.
